Terms of Service

These Terms govern your use of giddens.systems and any services provided by Giddens Systems LLC ("Giddens Systems," "we," "us"). By using this site or engaging our services, you agree to them.

Services

Giddens Systems provides marketing and web services to businesses, including website design and hosting, search engine optimization, CRM configuration, automated call intake, appointment booking, and customer follow-up systems.

The specific scope, deliverables, and fees for any engagement are set out in a separate written service agreement between us and the client. Where those terms conflict with these, the service agreement controls.

SMS messaging program

Program description. Giddens Systems operates an SMS messaging program for customers and prospective customers who have given express written consent. We send two categories of message:

• Transactional and informational — appointment confirmations and reminders, follow-ups on quotes and proposals, project updates, and responses to inquiries
• Promotional — occasional offers and announcements about our services, sent only to contacts who separately consented to marketing messages

How to join. You opt in by submitting the contact form at giddens.systems/contact and checking one or both of the optional consent checkboxes. Consent is not a condition of purchase, and the form can be submitted without consenting.

Message frequency. Message frequency varies based on your activity and inquiries. Most contacts receive fewer than ten messages per month.

Cost. Message and data rates may apply. Giddens Systems does not charge for text messages; your mobile carrier's standard rates apply.

How to opt out. Reply STOP to any message to stop receiving texts from us. You will receive one confirmation message and no further messages. You may rejoin at any time by opting in again through our contact form.

How to get help. Reply HELP to any message for assistance, or contact us at grant@giddens.systems.

Supported carriers. Our program is supported by major U.S. wireless carriers including AT&T, Verizon Wireless, T-Mobile, and Sprint. Carriers are not liable for delayed or undelivered messages.

Age requirement. You must be at least 18 years old to consent to receive text messages from Giddens Systems. We do not knowingly send messages to anyone under 18.

Privacy. No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details.

Fees and payment

• A one-time build fee is invoiced when a client engages us, and work begins on receipt
• Monthly service fees are billed in advance on a recurring basis
• Monthly services are month-to-month with no long-term commitment unless otherwise agreed in writing
• Payments are processed by third-party processors; by paying, you also agree to their terms
• Fees are exclusive of any applicable taxes

Cancellation and refunds

• Monthly services may be cancelled at any time with written notice. Cancellation takes effect at the end of the current billing period, and the current period is non-refundable.
• Build fees are non-refundable once work has begun, as they cover labor performed at the outset of an engagement.
• We may suspend or terminate services for non-payment after written notice.

Client responsibilities

You agree to provide accurate information, supply content and materials in a timely manner, maintain the rights to any content you give us, and use our services lawfully. Delays caused by outstanding client materials extend delivery timelines accordingly.

Ownership

On full payment, you own your website content, your domain, and your customer data. We retain ownership of our underlying tools, templates, frameworks, and methods.

You register and hold your own domain name. We do not hold client domains.

Third-party services

Our services rely on third-party platforms including hosting, CRM, telephony, and messaging providers. We are not responsible for their availability, performance, or changes to their terms and pricing.

No guarantee of results

We do not guarantee specific results, including rankings, lead volume, revenue, or conversion rates. Search engine and advertising platform behavior is outside our control.

Limitation of liability

To the maximum extent permitted by law, our total liability arising from these Terms or our services will not exceed the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

Confidentiality

Each party will protect the other's confidential business information and use it only as needed to perform under these Terms.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Collin County, Texas.

Changes

We may update these Terms. Continued use of the site or our services after changes are posted constitutes acceptance.
